In-store Competition Rules – ADA Distributors

  1. Introduction

1.1 This Promotional Competition (“Competition”) is organised by ADA Distributors known as (“Promotors”)

1.2 By entering this Competition, you confirm that you have read and understood these rules, and further that you agree to be legally bound hereby (“the Rules”).

  1. Duration

2.1 This Competition starts on 1 May 2020 and ends on 30 June 2020(“the Duration”).

2.2 The Promoters reserve the right to extend and/or limit the Competition Duration in their sole discretion.

  1. Participants – who may enter the competition

3.1 The Competition is open to permanent residents and citizens of South Africa over the age of 18 years in possession of a valid South African passport, except any employee, director, member, agent or consultant of the Promoter, and/or their immediate family members. The Promoters reserve the right to request proof of identity to determine whether the participant is at least 18 years of age.

3.2 By entering the Competition, all participants and winners agree to be bound by these Rules which will be interpreted by the Promoters, whose decision regarding any dispute will be final and binding. The Promoters reserve the right to amend and/or modify and/or cancel this Competition and any prizes (which have not yet been subject to a draw), or any aspect thereof, without notice at any time, for any reason which the Promoters reasonably deem necessary.

  1. Entry

4.1 Participants must write their full name, e-mail address and mobile telephone number on the back of a till slip which shows the total purchase to be R100 or more and place the completed till slip into the in-store competition box.

4.2 Participants may enter the promotional competition multiple times, with no limit, provided they follow the entry mechanics listed in 4.1 above.

  1. Prize and Draw

5.1 The Promoters reserve the right in their sole discretion to disqualify any entrant if they have reasonable grounds to believe that an entrant has breached any of the Rules, any applicable law (including copyright law). Each entrant acknowledges and agrees that any failure to comply with the Rules could lead to the Promoters disqualifying that person, without the Promoters giving any reason for such disqualification or granting any opportunity for challenge.

5.2 Winners will be notified via email or telephone or via social media. If the winner does not claim and collect their prize within one month of being notified of same, they will forfeit the prize.

5.3 The Promoters may advertise the Competition and its winners on social media and/or other digital platforms.

  1. General

6.1 The prizes are neither transferable nor redeemable for cash and the Promoters are not liable for any defect therein. The Promoters reserve the right to substitute the prizes with any other item of comparable commercial value.

6.2 Should any dispute arise in relation to the interpretation of these Competition Rules, the Promoters’ decision shall be final, and no correspondence will be entered into.

6.3 All participants and the winners, as the case may be, fully indemnify the Promoters and waive all claims of any nature whatsoever arising out of and/or from their participation in any way howsoever in this Competition (including, as a result of any act or omission, whether as a result of negligence, misrepresentation, misconduct or otherwise on the part of the Promoters) and/or use of the prize(s).

6.4 The Promoters may require the winners to complete and submit an information disclosure agreement and indemnification to enable the Promoters to ensure compliance with these rules and the Consumer Protection Act 68 of 2008 (“CPA”). Should any winner refuse or be unable to comply with this rule for any reason, such winner will be deemed to have rejected the prize(s) and withdraw from the Competition; in this event, the prize(s) shall revert back to the Promoters.

6.5 The Promoters may require the winners to be identified, photographed and published in social media, electronic media, printed media, or to appear on radio and television, when accepting their prizes and/or after having received their prizes. The winners will be given the opportunity to decline the publication of their images and to participate in the Promoters’ marketing material in so far as it relates to the Competition.

6.10 Any provision of these Rules or the Competition which is held to be invalid or unenforceable shall be ineffective to the extent of such invalidity or unenforceability without invalidating or rendering unenforceable the remaining provisions thereof.

6.11 This Competition shall comply with, and will be subject to, any peremptory provisions of the CPA, which are deemed to be incorporated herein. In the event of any conflict between these rules and the CPA provisions, the latter shall prevail.
